THE INITIATIVE: TERMS & CONDITIONS

Effective Date: 20 April 2026

1. Overview

The Memoirs by Him Nomination Initiative (“Initiative”) allows members of the public to nominate themselves or another man to receive a Memoirs by Him journal.

The Initiative is intended to support reflection, clarity, personal growth, and emotional wellbeing for men.

Memoirs by Him will give away up to five Memoirs by Him journals to up to five individual nominees selected through the Initiative. If fewer than five suitable nominations are received, Memoirs by Him may choose to provide fewer than five journals.

By submitting a nomination, nominators agree to these Terms and Conditions.

2. Definitions

For clarity:

“Nominator” means the person submitting a nomination, either on behalf of themselves or another person.

“Nominee” means the person being nominated to receive a Memoirs by Him journal. This may be the same person as the nominator if they are self-nominating.

“Selected Recipient” means a nominee selected by Memoirs by Him to receive a journal.

“Journal” means one Memoirs by Him journal provided as part of the Initiative.

3. Eligibility

Participation in the Initiative is open to individuals who:

  • Are at least 18 years old at the time of nomination.
  • Are located in Australia.
  • Provide accurate, complete, and truthful information in the nomination form.
  • Comply with these Terms and Conditions.

Nominees must also be located in Australia, as journals will only be shipped Australia-wide.

Memoirs by Him reserves the right to disqualify any nomination that does not meet the eligibility requirements, contains false or misleading information, contains inappropriate or harmful content, or does not align with the purpose of the Initiative.

4. No Purchase Necessary

No purchase is necessary to participate in the Initiative.

5. Nomination Period

Nominations remain open on an ongoing basis and close at 11:59pm AEST on the last day of each month.

Memoirs by Him reserves the right to extend, modify, suspend, or cancel the Initiative at any time.

6. Nomination Process

To submit a nomination, nominators must complete the official nomination form provided by Memoirs by Him.

The nomination form may ask for information including, but not limited to:

  • Nominator’s first name.
  • Nominator’s email address.
  • Nominator’s Instagram handle, if applicable.
  • Whether the nominator is nominating themselves or someone else.
  • Nominee’s first name.
  • Nominee’s Instagram handle, if applicable.
  • A brief written explanation of why the nominee could benefit from receiving a Memoirs by Him journal.
  • Confirmation that the nominator has read and agrees to these Terms and Conditions.

All nominations must be submitted in good faith.

Memoirs by Him may remove, disregard, or decline any nomination that is incomplete, inaccurate, misleading, inappropriate, offensive, harmful, or inconsistent with the purpose of the Initiative.

7. Nominating Someone Else

Where a nomination is submitted on behalf of another person, the nominator confirms that they have a genuine relationship with the nominee and a reasonable basis to believe the nominee would be open to being nominated.

Nominators must not submit private medical information, mental health diagnoses, crisis information, trauma details, or other highly sensitive personal information about another person.

Nominations should focus on why reflection, clarity, personal growth, or space to think may be valuable for the nominee.

Memoirs by Him will not publicly share a nominee’s name, Instagram handle, image, likeness, story, nomination details, or other personal information without first obtaining direct consent from the nominee.

8. Selection of Recipients

Memoirs by Him will review eligible nominations and select up to five individual nominees to receive one Memoirs by Him journal each.

Selected Recipients will be chosen at Memoirs by Him’s sole discretion based on factors including, but not limited to:

  • Alignment with the purpose of the Initiative.
  • Thoughtfulness of the nomination.
  • Whether Memoirs by Him believes the journal may be genuinely valuable to the nominee.
  • Suitability of the nomination.

This Initiative is not a game of chance. Recipients will not be selected randomly.

Receipt of a journal is not guaranteed for any nomination.

If Memoirs by Him receives fewer than five suitable nominations, Memoirs by Him may choose to provide fewer than five journals.

9. Announcement of Selected Recipients

Memoirs by Him intends to announce the selected recipients on the first day of every month at approximately 8:00pm AEST.

Announcements may be made via the Memoirs by Him website, email, Instagram, or other Memoirs by Him communication channels.

Public announcement of any Selected Recipient is subject to that person’s consent. If consent has not been obtained, Memoirs by Him may delay, limit, anonymise, or withhold public announcement of that recipient’s details.

Memoirs by Him may contact selected nominators and/or nominees directly before or after the public announcement.

If a Selected Recipient cannot be contacted, does not respond within a reasonable period, declines to receive the journal, is ineligible, or does not provide any required information, Memoirs by Him may select another recipient or choose not to allocate that journal.

10. Journal Delivery

Each Selected Recipient may receive one Memoirs by Him journal.

Journals will be shipped Australia-wide only.

Selected Recipients may be required to provide a valid Australian delivery address in order to receive the journal.

Journals are not transferable, exchangeable, or redeemable for cash.

Memoirs by Him is not responsible for lost, delayed, damaged, misdirected, or undeliverable shipments, except where required by law.

11. Content, Stories, and Promotional Use

Selected Recipients may be invited to share their experience using the journal, including through written, photographic, video, social media, or interview-style content.

Participation in any content is entirely optional and subject to separate written consent.

Declining to participate in content will not affect a Selected Recipient’s eligibility to receive a journal.

Submission of a nomination does not automatically grant Memoirs by Him permission to publicly identify a nominee or publish sensitive details about them.

If Memoirs by Him wishes to publish a nomination, story, testimonial, photograph, video, social media handle, or other content involving a nominee, separate consent will be requested before publication.

Memoirs by Him may edit approved content for clarity, length, formatting, and brand consistency, provided the meaning is not materially changed.

12. Instagram Handles

Nominators may be asked to provide Instagram handles for identification, communication, or verification purposes.

Providing an Instagram handle does not guarantee that the handle will be used publicly.

Memoirs by Him will not publicly tag, identify, or reference a nominee’s Instagram handle without consent from the nominee.

13. Privacy and Data Use

Memoirs by Him will collect and use personal information submitted through the nomination form for purposes related to administering the Initiative, reviewing nominations, contacting nominators and nominees, selecting recipients, delivering journals, and managing any approved communications or content.

Personal information may include names, email addresses, Instagram handles, nomination responses, and delivery details.

Memoirs by Him will handle personal information in accordance with its Privacy Policy.

Memoirs by Him will not sell personal information submitted through the Initiative.

Memoirs by Him will not share personal contact information publicly.

Memoirs by Him may send administrative communications relating to the Initiative, including confirmation emails, selection updates, requests for additional information, nominee consent, and delivery-related messages.

Nominators may also choose to opt in to receive marketing communications from Memoirs by Him, including product updates, offers, journal prompts, stories, and community updates.

Marketing communications will only be sent where consent has been provided or where otherwise permitted by law.

Recipients may unsubscribe from marketing communications at any time.

14. Sensitive Information

Nominators should not submit sensitive personal information about another person.

This includes, but is not limited to:

  • Medical information.
  • Mental health diagnoses.
  • Details of trauma.
  • Crisis-related information.
  • Addiction history.
  • Relationship conflict.
  • Financial hardship.
  • Legal issues.
  • Any other private information the nominee has not consented to share.

Memoirs by Him may delete, edit, disregard, or decline nominations that contain sensitive, private, inappropriate, or unsuitable information.

If a nomination suggests immediate risk of harm or crisis, Memoirs by Him is not responsible for providing crisis support, medical advice, mental health advice, or emergency intervention.

The Memoirs by Him journal is not a substitute for professional medical, psychological, or crisis support.

15. Communications

By submitting a nomination, nominators agree that Memoirs by Him may contact them about the Initiative.

This may include nomination confirmation, recipient selection, requests for additional information, nominee consent, delivery coordination, and other Initiative-related updates.

Where a nominee is selected, Memoirs by Him may contact the nominator first to help facilitate communication with the nominee.

Memoirs by Him will not require a nominee to participate in any public content, marketing, or promotional activity as a condition of receiving a journal.

Marketing communications are separate from Initiative-related communications. Nominators will only receive marketing emails from Memoirs by Him where they have opted in or where otherwise permitted by law, and they may unsubscribe at any time.

16. Limitation of Liability

To the maximum extent permitted by law, Memoirs by Him is not responsible for:

  • Lost, delayed, incomplete, misdirected, or unsuccessful nominations.
  • Technical errors, website issues, form submission issues, or internet disruptions.
  • Incorrect or incomplete contact details provided by nominators or nominees.
  • Any failure by a Selected Recipient to receive communications or delivery.
  • Any loss, damage, or injury arising from participation in the Initiative, except where caused by Memoirs by Him’s negligence or where liability cannot be excluded under Australian law.

Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer rights or guarantees that cannot be excluded under Australian law.

17. Modification or Cancellation

Memoirs by Him reserves the right to modify, suspend, extend, or cancel the Initiative at any time, including where circumstances arise that are outside Memoirs by Him’s reasonable control.

If the Initiative is modified, suspended, or cancelled, Memoirs by Him may, at its discretion, notify participants through its website, email, social media, or other communication channels.

18. Disqualification

Memoirs by Him may disqualify any nomination or participant if it reasonably believes that:

  • The nomination is false, misleading, offensive, harmful, or inappropriate.
  • The nomination contains sensitive personal information about another person.
  • The participant has breached these Terms and Conditions.
  • The participant has attempted to manipulate, misuse, or interfere with the Initiative.
  • The nomination does not align with the purpose of the Initiative.

19. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.

Participants submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

20. Acceptance of Terms

By submitting a nomination, the nominator confirms that they:

  • Are at least 18 years old.
  • Are located in Australia.
  • Have read and understood these Terms and Conditions.
  • Agree to be bound by these Terms and Conditions.
  • Have provided accurate and truthful information.
  • Understand that receipt of a journal is not guaranteed.
  • Understand that no nominee’s personal details, story, image, likeness, or social media handle will be shared publicly without direct consent.
  • Understand that marketing communications are optional and separate from Initiative-related communications.
